A term for a form of government. The literal Greek translation “rule of the people” is of little help, because dictatorships now also call themselves “true” democracies. That is why it is necessary to name characteristic features that, in our understanding, characterize a democratic order of rule. Democracy, Greek for “rule of the people”, was practiced by its inventors as a direct democracy: the free men – only they were considered the people at that time – gathered on the market square of their city-state (Polis) and immediately decided there themselves about everything that concerned the polis, that is, about all political issues.
This marketplace democracy is no longer possible in today’s big states. Representative democracy has taken its place. Representatives elected by the people on a temporary basis (representatives), this time men and women, decide the ongoing political issues as trustees for the people. In addition, elements of direct democracy can also occur in representative democracy: e.g. in an internal link:referendum the citizens entitled to vote directly on a bill that comes from their midst, or in an internal link:referendum decide whether they subsequently give their consent to a parliamentary law or refuse it. The constitutions of all German federal states provide for referendums, Bavaria and Hesse also a referendum on constitutional amendments. At the federal level, there is neither the possibility of a referendum, nor the possibility of a referendum, which many European states are familiar with.
According to Article 20 of the Basic Law, the Federal Republic is a democracy. In this form of government, the people exercise the power of domination. Democracies are characterized, among other things, by respect for human rights, separation of powers, accountability of the government, independence of the courts, legality of administration, a multi-party system, as well as free, equal and secret elections. The Federal Republic is a representative democracy in which the people “rule” through elected representatives of the people. These people’s representatives form the Bundestag, which is the only directly democratically elected constitutional body.
